$2 Billion health program marred by ethical breaches and government oversight failures

In a shocking revelation, the first public hearing of the probity and ethics inquiry conducted on September 8th by the Joint Committee of Public Accounts and Audit (JCPAA) has cast a shadow over the Department of Health and Aged Care and its handling of the Community Health and Hospitals Program (CHHP).

The CHHP, entailing a staggering $2 billion in grants and funding allocated to Primary Health Networks, non-government organisations, and state and territory governments, has come under scrutiny for its administrative failures and ethical breaches.

Committee Chair Julian Hill MP did not mince words as he expressed his concerns, stating, “The report regarding the Community Health and Hospitals was very concerning. Serious shortcomings were found by the Australian National Audit Office (ANAO) in Department of Health’s administration of the Community Health and Hospitals Program. Light must be shone on failings such as these so we can strengthen government integrity and accountability.”

One particularly troubling revelation was the allocation of grants without adhering to the Commonwealth Grants Rules and Guidelines. Executive oversight, risk management, and fraud prevention were found to be lacking, and projects funded under grant agreements were managed inconsistently with established guidelines.

“One of the themes that we’ve had through the grants process is that across many departments there was found to be a lot of incidences of the department not doing their own fiduciary duties in relation to the minister and not providing the correct advice to the minister on the correct administration of different grants programs and the legal requirements,” remarked Hon Linda Reynolds CSC LP, Senator for WA.

Hon Dr. Jim Chalmers MP, Treasurer of Australia, did confirm that 102 out of 171 projects under CHHP are either delivering services or have been completed. However, Committee Chair Julian Hill raised critical questions about the allocation process, highlighting 34 projects that were allocated without Expression of Interest (EOI) and significant breaches reported under Section nine of the Public Governance, Performance and. Accountability (PGPA) Act 2013.

Peta Murphy ALP, Member for Dunkley VIC, was quick to emphasise the gravity of the situation, stating, “Grants were given out despite legal advice given to say this is unlawful.”

Grant Hehir, Auditor-General, added, “There were eleven grants where the legal advice was that there was a high risk that they would be unlawful, and the other three grants were breaches of the grant rules and guidelines.”

“In that period, there was a confluence of different pressures or influences that did not make for a great environment for sound decision making. I would say that if we had the arrangements that we’ve got in place now back then, the likelihood of this happening would be greatly reduced,” commented Charles Wann, Chief Operating Officer, Department of Health

Department of Health’s monitoring and evaluation of the CHHP were deemed partly effective, with limited oversight of individual project performance and an absence of an overall program evaluation. While some lessons were identified, the process remained far from systematic.

The Department of Health and Aged Care acknowledges the report findings, accepts the recommendations, and has initiated measures to address the shortcomings. They affirm their commitment to managing public resources efficiently, effectively, economically, and ethically in accordance with the PGPA legislation.

In the wake of this controversial report, the Department faces severe scrutiny and the imperative to rebuild public trust, while the broader implications of this inquiry on government integrity and ethics continue to unravel.
